1. Domestic recruitment type planned travel contract

(1) This trip is planned, solicited, and implemented by Kimita Kotsu Co., Ltd. (682-1 Higashiiri-kun, Kimita-cho, Miyoshi City, Hiroshima Prefecture, Hiroshima Prefectural Governor Registered Travel Agency No. 2-391). Participating customers will enter into a domestic recruitment-type organized travel contract (hereinafter referred to as the “travel contract”) with Kimita Kotsu Co., Ltd. (hereinafter referred to as the “Company”).

(2) This document (hereinafter referred to as the “Common Matters Document”) is a part of the transaction conditions explanation document issued to the customer based on Article 12-4 of the Travel Agency Act, and if a travel contract is established, This is a part of the contract document pursuant to Article 12-5 of the Travel Agency Act and Article 9, Paragraph 1 of our travel agency terms and conditions (recruitment-type planned travel contract section) approved by the Japan Tourism Agency.

(3) The contents and conditions of the travel contract include the conditions stated in individual travel plans, etc. (hereinafter referred to as “brochures, etc.”) described in recruitment advertisements, pamphlets, and flyers, as well as common matters documents, travel A definitive document called the final travel itinerary (hereinafter referred to as the “Final Travel Itinerary”) handed to you before departure (hereinafter referred to as the “Final Travel Itinerary”), and the terms and conditions of our travel agency approved by the Japan Tourism Agency (recruitment-type planned travel contract section) (hereinafter referred to as the “Terms and Conditions”) ).

(4) Our company provides services so that customers can receive transportation, accommodation, and other travel-related services (hereinafter referred to as “travel services”) provided by transportation and accommodation facilities, etc. according to the travel itinerary determined by our company. We will take care of making the arrangements and managing your itinerary.

2. Application for travel contract

(1) Customers who wish to apply for a travel contract must fill in the prescribed information on the travel application form (hereinafter referred to as the “Application Form”) prescribed by the Company, and then receive the amount specified by the Company in the pamphlet, etc. Applications must be submitted along with the application fee or the full amount of the travel fee (hereinafter referred to as the “application fee, etc.”). The application fee, etc. will be treated as part or all of the “travel fee,” “cancellation fee,” and “penalty fee.”

(2) The Company may accept applications for travel contract reservations by telephone, mail, facsimile, the Internet, or other communication means. In this case, the travel contract has not been concluded at the time of the reservation, and you must submit the application form and pay the application fee to the Company within three days from the day after the Company notifies you of acceptance of the reservation. Please do so. If the application fee is not paid within this period, the Company will treat the reservation as not having been applied for.

(3) If a person who is under 20 years of age as of the start date of the trip is participating alone without a guardian, written consent from the representative of the parent or guardian is required. In addition, if you are under 15 years old or a junior high school student, you may be required to be accompanied by a guardian (those under 20 years old will not be considered a guardian).

(4) When there are customers who require special consideration.

  ① Depending on the customer’s situation, special consideration or measures may be required that are not included in the original arrangements. People with poor health, people who use equipment such as wheelchairs, people with physical or mental disabilities, people with food allergies or animal allergies, people who are pregnant, people who may become pregnant, or people with physical disabilities. If you are traveling with a disability assistance dog (guide dog, hearing dog, service dog) or otherwise require special consideration, please let us know when you apply for the trip that you require special consideration in order to participate in the trip. (Please notify us immediately if any of these conditions occur after you have concluded your travel contract.) We will provide you with further information, so please let us know in detail what measures you will need to take during your trip.

  ② If we receive the request mentioned in ① above, we will respond to it to the extent possible and reasonable. In this case, we may ask you about your situation and the necessary measures, or we may ask you to provide them in writing.

  ③ In order to ensure the safe and smooth operation of the trip, our company may require the traveler to be accompanied by an assistant or companion, submit a medical certificate from a doctor, etc., or change the content of the travel services entrusted by the contract manager. We may make suggestions such as: Additionally, if we are unable to arrange the measures requested by the customer, we may refuse to conclude the travel contract.

  ④ In principle, the costs required for special measures taken by the Company for the customer based on the customer’s request shall be borne by the customer.

(5) Customers with nationalities other than Japan may be required to make separate procedures and arrangements, so please be sure to notify us at the time of application.

(6) Group/group contracts

  ① Regarding the conclusion of a travel contract applied for by multiple customers traveling on the same itinerary at the same time by designating a responsible representative (hereinafter referred to as the “Contract Responsible Person”), the Company shall comply with this clause (6) ②. The provisions of ~⑤ will apply.

  ② Unless a special agreement has been concluded, the person responsible for the contract shall have all agency rights regarding the conclusion and cancellation of travel contracts for the travelers composing the organization/group (hereinafter referred to as “members”). Transactions related to travel services related to the organization/group will be conducted with the person responsible for the contract.

  ③ The person responsible for the contract shall submit a list of members (hereinafter referred to as the “Tourist List”) to the Company by the date determined by the Company.

  ④ The Company shall not be responsible for any debts or obligations that the Contract Responsible Person currently owes or is expected to bear in the future to Members.

  ⑤ If the person in charge of the contract does not accompany the group/group, after the start of the trip, the Company will consider the member selected in advance by the person in charge of the contract to be the person in charge of the contract.

(7) As a general rule, we cannot take other actions due to the customer’s convenience. However, special conditions may apply depending on individual travel plans.

(8) If you decide to leave the tour due to your own circumstances, you will need to notify us in writing of your decision, whether or not you will be returning, and the expected date and time of your return.

(9) As a measure to prevent the spread of the new coronavirus, customers are required to wear masks and disinfect their hands.

(10) Please refrain from participating in the trip depending on your physical condition, such as exhibiting fever or other symptoms suspected of being infected with the new coronavirus at the time of departure.

(11) If a customer shows symptoms such as a fever that suggest infection with the new coronavirus during the trip, or if the customer becomes a close contact, the customer will be asked to leave the trip.

3. Refusal to conclude a travel contract

Our company may refuse to conclude a travel contract in the following cases:

(1) When the number of customers who applied reaches the planned number of applications.

(2) Regarding a trip for which the Company has specified special conditions for participation, when the participant’s gender, age, qualifications, skills, and other conditions do not match the conditions specified by the Company.

(3) When the customer is found to be an organized crime group, a member of an organized crime group, a quasi-member of an organized crime group, a person associated with an organized crime group, a company associated with an organized crime group, a corporate racketeer, or other anti-social force.

(4) When the customer makes violent demands, unreasonable demands, threatening behavior or violence regarding transactions, or acts similar to these.

(5) When a customer spreads rumors, uses fraudulent means or intimidation to damage the credibility of our company, interferes with our business, or engages in similar acts.

(6) When the Company determines that the Customer may cause trouble to other Customers or impede the smooth implementation of group activities.

(7) When it is convenient for our company’s business.

4. When the travel contract is established

A travel contract will come into effect when the Company consents to the conclusion of the travel contract and receives the application fee pursuant to Paragraph 2 (1). However, the establishment of a travel contract based on a communications contract shall be pursuant to the provisions of Paragraph 26.

5. Delivery of contract documents

(1) Immediately after the conclusion of the travel contract, the Company will provide the customer with a contract document containing the travel itinerary, details of travel services, travel fees, other travel conditions, and matters related to the Company’s responsibilities. The contract document consists of common matters documents such as pamphlets.

(2) The scope of travel services that the Company is obligated to arrange and manage the itinerary under the travel contract shall be as stated in the contract document in (1) of this section.

6. Final trip itinerary

(1) If it is not possible to state the confirmed travel itinerary or the name of the transportation or accommodation facility that is important in the display in the contract document referred to in the preceding paragraph (1), the name of the accommodation facility that is planned to be used and the transportation facility that is important in the display is required. In the case where an application for a travel contract is made on or after the day before the travel start date (counting from the day before the travel start date) after the delivery of the contract document (the 7th day counting from the day before the travel start date). will provide you with a final itinerary that includes these confirmed status by the date specified in the contract document (up to the travel start date).

(2) In the case of (1) of this section, if we receive an inquiry requesting confirmation of the arrangement status, we will promptly and appropriately explain the arrangement status even before handing over the final itinerary. Masu.

(3) If we provide you with a final itinerary, the scope of travel services that we are obligated to arrange and manage the itinerary will be specified in the final itinerary.

(4) A final travel itinerary may not be created.

7. Payment deadline and application for travel expenses

(1) The travel fee refers to the “travel fee to be paid” in Section 8 , and the travel fee is indicated on the pamphlet or plan. Please check the departure date, number of guests, usage details, etc.

(2) The travel fee must be paid before the 21st day counting from the day before the travel start date so that we can confirm the payment.

(3) If you apply for a travel contract on or after the 21st day counting from the day before the travel start date, payment must be made at the time of application or by the deadline designated by our company prior to the travel start date.

(4) Among participating customers, if there is no special note, those who are 12 years of age or older as of the start date of the trip will be charged an “adult price”, and 6 years of age or older (3 years of age or older for airplane travel courses)12 If you are under the age of 10, you will be charged a “child price”. Children under the age of 3 who do not use their own airline seat or bed in the cabin will be charged an “infant price.” Unless otherwise specified in the brochure or plan, the “adult price” will be applied in all cases.

(5) Regarding courses and plans that use a chartered bus or taxi, infants who are between 3 and 5 years of age on the day of the trip will be required to secure a seat on the chartered bus or taxi according to our safety standards. This is the “travel fee for infants”. Travel fees for infants do not include travel services (meals, etc.) other than a seat on a chartered bus or taxi.

8. Travel fee to be paid

“Travel price to be paid” refers to the “amount displayed as the travel price,” “the amount displayed as an additional charge,” and “the amount displayed as a discount price” on pamphlets, etc. This total amount includes the “application fee, etc.” in Paragraph 2(1), the “cancellation fee” in Paragraph 14(1), the “penalty fee” in Paragraph 15(2), and the “change compensation” in Paragraph 25. This is the basis for calculating the amount of money.

9. What is included in the travel fee

(1) Fares and charges of the transportation facility used as specified in the itinerary. However, unless otherwise specified, the seat class will be economy class or standard seat.

(2) Accommodation fees, taxes and service charges at the accommodation locations specified in the itinerary. Please note that taxes other than consumption tax, such as bathing tax and accommodation tax, may not be included. In addition, unless otherwise specified, the standard is based on the capacity of each room. If the customer wishes to use the hotel with fewer people than the capacity per room, an additional fee will be charged separately.

(3) Sightseeing fees (admission fees, etc.) specified in the itinerary.

(4) Meal fees, taxes and service charges specified in the itinerary.

(5) Consumption tax and other taxes, service charges.

(6) Other expenses specified in the pamphlet, etc. as “included in the travel fee.”

(7) Expenses for accompanying a tour conductor in the case of a tour guide accompanying plan.

(8) Expenses for accompanying a national guide interpreter or regional guide interpreter in the case of an accompanying plan for a national guide interpreter or a regional guide interpreter.

Due to the customer’s convenience, the above fees will not be refunded even if some of the fees are not used.

10. Things not included in the travel price

Items other than Paragraph 9 are not included in the travel fee. Here are some examples.

(1) Transportation costs, entrance fees, etc. for locations/sections that are stated as “free movement”, “free sightseeing”, “separate fees”, “customer’s responsibility”, etc. during the itinerary described in the pamphlet or plan.

(2) Excess baggage charges (for items exceeding the specified weight, capacity, and number of items).

(3) Additional fares and charges (e.g., fuel surcharges) imposed by transportation agencies. However, this does not apply unless clearly specified as included in the itinerary.

(4) Airport facility usage fees, etc. However, this excludes cases where it is clearly stated as included in pamphlets or plans.

(5) Bathing tax and accommodation tax when using accommodation facilities. However, this excludes cases where it is clearly stated as included in pamphlets or plans.

(6) Miscellaneous expenses of a personal nature such as cleaning fees, telecommunication charges such as telegraph and telephone charges, refrigerator usage charges, gratuities for maids at accommodation facilities, and other additional food and beverages, as well as associated taxes and service charges.

(7) Medical expenses related to injury or illness.

(8) Participation fees for optional tours, etc. (excursions with separate fees) that only those who wish to participate can participate in.

(9) Other additional charges not included in the itinerary that arise at the customer’s own request (tour fees, meal fees, photography fees, transportation fees, etc.).

(10) Transportation and accommodation expenses from your home to the departure and arrival points.

11. Changes to travel contract details

Even after a travel contract has been concluded, our company may be subject to natural disasters, wars, riots, suspension of travel services provided by travel service providers, orders from public offices, provision of transportation services that are not in accordance with the original operation plan, etc. In the event that an unrelated reason occurs, if it is unavoidable in order to ensure the safe and smooth implementation of the trip, the customer will be promptly informed in advance of the reason why the unrelated reason is unrelated and the causal relationship with the said reason. We may change the contents of the travel contract by explaining the following. However, in the case of an emergency, if it is unavoidable, we will explain the changes after they have been made.

12. Change of travel fee amount

After the travel contract is established, we will not change the amount of the travel fee except in the following cases.

(1) Due to significant changes in the economic situation, the applicable fares and charges of the transportation facility used are normally expected to be different from the applicable fares and charges that have been published as valid at the time specified at the time of recruitment. If the amount is increased or decreased by a significantly greater amount, we will increase or decrease the amount of the travel fee within the range of the increased or decreased amount. However, if the travel fee is to be increased, the customer will be notified of this prior to the 15th day counting from the day before the travel start date. If the applicable fares/charges are reduced, the travel fee will be reduced by the reduced amount.

(2) If the contract contents are changed pursuant to Paragraph 11 and the costs required to conduct the trip decrease or increase (the increase in costs may occur even if the travel service provider is providing the travel service) (Except in cases where there is a shortage of seats, rooms, or other facilities at the travel service provider), the amount of the travel fee may be changed within that range when the contents of the travel contract are changed. You must to do something before you go on. However, cancellation fees, penalty fees, and other expenses that have already been paid or will need to be paid for travel services that were not provided due to changes in the travel contract details will be borne by the customer.

(3) In the event that we state in a pamphlet, etc. or contract document that the travel fee differs depending on the number of users of the travel service providing institution, the Company shall, after the conclusion of the travel contract, determine that the number of users will vary, regardless of reasons attributable to our company. If there is a change, we will change the amount of the travel fee. For example, if some of the customers who applied for multiple rooms cancel their contracts and the other customers end up using the room with fewer people than the capacity, or in the case of a Western-style room, etc. If a single room is used, the “cancellation fee” in Section 14 (1) will be charged from the customer who canceled the contract, as well as the customer who uses the room with fewer people than the capacity per room, and the customer who canceled the contract. Customers who stay in a single room will be charged a separately determined additional fee and an additional fee for a single room.

13. Customer replacement

(1) The customer may transfer the status under the travel contract to another person with the consent of the Company. In this case, please fill in the prescribed information on the form prescribed by the Company and submit it to the Company together with the prescribed amount of handling fee (which may be the same amount as the cancellation fee pursuant to Section 14 (1)). Additionally, if you have already issued a ticket, you will be charged a separate fee for reissuing it.

(2) The transfer of the status under the travel contract will become effective when it is approved by our company, and from then on, the person who transfers the status under the travel contract will inherit all rights and obligations regarding this travel contract. . Please note that we may refuse to make a replacement due to reasons such as the transportation facility, accommodation facility, etc. we use being unwilling to accept the replacement.

(3) The Company may not accept the transfer of the status under the travel contract to another person based on individual travel plans.

14. Your right to cancel your travel contract

(1) When a cancellation fee is charged from the customer

  ① The customer may cancel the travel contract at any time by paying the cancellation fee specified in the table below. The “date of cancellation of the travel contract” is based on the time when the customer requests cancellation during the business days and business hours of the office for which the application was made. Faxes, etc. received on non-business days or after business hours will be treated as requests received on the next business day.

  ② In the case of cancellation due to the handling of various loans, etc. that are not our responsibility, we will also charge the cancellation fee set forth in (1) ① of this section.

  ③ Any changes to the departure date, changes to individual travel plans, provision of travel services, etc. during the itinerary due to the customer’s convenience will be considered a cancellation of the entire trip, and the cancellation fee set forth in (1) ① of this section will be applied.   ④ If you have a fever or any symptoms suspected of being infected with the new coronavirus at the time of departure, please refrain from participating in the trip. In that case, the travel contract will be canceled due to the customer’s reasons, and the cancellation fee set forth in (1) ① of this section will be charged.

When the travel contract is canceled pursuant to (1) ① ② ③ of this section, we will refund the remaining amount after deducting the prescribed cancellation fee from the already paid travel fee (or application deposit, etc.). If the application fee alone does not cover the cancellation fee, the difference will be charged.

(2) In the following cases, the customer may cancel the travel contract without paying a cancellation fee before the start of the trip.

  ① When the contract contents are changed based on Clause 11. However, this is limited to cases where the change is listed in the left column of the table in Paragraph 24 or is otherwise important.

  ② When the travel fee is increased based on Paragraph 12 (1).

  ③ In the event of a natural disaster, war, riot, suspension of the provision of travel services such as transportation/accommodation facilities, orders from public offices, or other reasons, it becomes impossible or impossible for the travel to be carried out safely and smoothly. When there is an extremely high risk of

  ⑤ When it becomes impossible to carry out the trip according to the itinerary stated in the contract document due to reasons attributable to the Company.

(3) If the customer cancels or temporarily withdraws from the travel contract during the trip due to personal reasons after the trip has begun, it will be considered a waiver of the customer’s rights and all refunds will be given. (This includes cases where you are asked to leave the tour pursuant to Paragraph 2 (11).)

(4) If the customer is unable to receive the travel service stated in the contract document due to reasons not attributable to the customer, or if the Company informs the customer to that effect, the customer shall not be able to receive the travel service without paying a cancellation fee. may cancel the travel contract for the part of the travel contract that can no longer be accepted. In this case, our company must pay or will pay cancellation fees, penalty fees, and other fees to the travel service from the amount of the travel fee that is no longer available for the travel service. We will refund the amount to the customer after deducting the amount related to expenses (limited to cases where it is not due to reasons attributable to our company).

15. Our right to cancel the travel contract (cancellation before the start of the trip)

(1) In the following cases, we may cancel the travel contract before the start of the trip by explaining the reasons to the customer.

  ① When it is discovered that the customer does not meet the gender, age, qualifications, skills, and other conditions for participating travelers specified in advance by the Company.

  ② When it is determined that the customer is unable to continue the trip due to illness, absence of necessary caregivers, or other reasons.

  ③ When it is recognized that there is a risk that the customer may cause trouble to other customers or interfere with the smooth implementation of the group tour.

  ④ When the customer requests a burden that exceeds the reasonable range regarding the contract contents.

  ⑤ When it is found that the customer falls under Paragraph 3 (3) to (5).

  ⑥ When the number of customers does not reach the minimum number of participants listed in the pamphlet or each course. In this case, we will notify the customer that the trip will be canceled before the 13th day (3rd day for day trips) counting from the day before the trip start date.

  ⑦ When the travel conditions specified by the Company in advance at the time of conclusion of the travel contract are not fulfilled, such as insufficient snowfall during a trip for the purpose of skiing, or when there is an extremely high possibility that such conditions will not be fulfilled.

  ⑧ In the event of a natural disaster, war, riot, suspension of the provision of travel services such as transportation and accommodation facilities, orders from public offices, or other reasons in which the Company cannot be involved, the travel itinerary stated in the contract document may be canceled. When it becomes impossible, or there is a strong possibility that it will become impossible, to carry out a safe and smooth trip.

(2) If the customer does not pay the travel fee by the date specified in Paragraph 7, the Company will assume that the customer has canceled the travel contract on the day following the date. In this case, the customer will be required to pay to the Company a penalty fee equivalent to the cancellation fee specified in Section 14 (1).

16. Our right to cancel the travel contract (cancellation after the start of the trip)

(1) In the following cases, our company may cancel a part of the travel contract by explaining the reason to the customer even after the trip has started.

  ① When the customer is deemed unable to travel due to illness, absence of a necessary caregiver, or other reasons.

  ② When it is found that the customer falls under Paragraph 3 (3) to (5).

  ③ Disobedience of our company’s instructions by tour conductors and other persons to ensure the safe and smooth travel of our customers, or assault or intimidation of these persons or other accompanying customers, disrupting the discipline of group behavior, When it interferes with the safe and smooth implementation of travel.

  ④ It becomes impossible to continue the trip due to natural disasters, war, riots, suspension of travel services such as transportation/accommodation facilities, orders from government offices, or other reasons beyond our control. When.

(2) When the Company cancels the travel contract pursuant to paragraph (1) of this clause, the contractual relationship between the Company and the customer will cease to exist only in the future. In other words, the Company’s obligations regarding the travel services already provided to the Customer shall be deemed to have been effectively paid. In addition, in this case, we will deduct from the amount of the travel fee related to the travel service that the customer has not yet received the provision of, cancellation fees, penalty fees, and other fees that have already been or will be paid for the travel service. We will refund the amount to the customer minus the amount related to the necessary expenses.

(3) If the Company cancels the travel contract after the start of the trip pursuant to (1)①④ of this paragraph, the Company shall, at the customer’s request, provide necessary information to return to the place of departure at the customer’s full expense. We will arrange travel services for you.

17. Refund of travel fee

(1) In the event that the travel fee is reduced pursuant to the provisions of Section 12(1)(2)(3) or the travel contract is canceled pursuant to the provisions of Sections 14, 15, or 16, the Company shall When there is an amount to be refunded to the customer, in the case of a refund due to cancellation before the start of the trip, within 7 days from the day after the date of cancellation, and in the case of a refund due to reduction or cancellation after the start of the trip, the refund shall be within 7 days from the day after the cancellation. We will refund the amount to the customer within 30 days starting from the day after the tour end date stated in the document.

(2) For refunds after the coupons have been delivered, the coupons that were handed over will be required. If coupons are not submitted, the travel fee may not be refunded.

18. Itinerary management

Our company strives to ensure safe and smooth travel for our customers, and performs the following services for our customers. However, this shall not apply if the Company has entered into a special agreement with the customer that differs from this.

(1) If it is recognized that there is a risk that the customer will not be able to receive travel services during the trip, take the necessary measures to ensure that the customer can receive the travel services in accordance with the travel contract.

(2) If you are forced to change the contract despite taking the measures in (1), make arrangements for alternative services. In this case, when changing the itinerary, please make sure that the changed itinerary meets the purpose of the original itinerary, and when changing the contents of the travel service, please make sure that the changed travel itinerary is consistent with the purpose of the original itinerary. Efforts should be made to keep changes to the contract contents to a minimum, such as by making efforts to ensure that the travel services are similar to the original travel services.

19. Our instructions

When traveling in a group from the start of the trip until the end of the trip, customers must follow our company’s instructions to ensure a safe and smooth trip.

20. Tour conductor etc.

(1) The presence or absence of a tour conductor will be indicated in the pamphlet, etc.

(2) Tourist accompanying plan

  ① In the tour accompanied course, a tour conductor accompanies the entire trip and performs all or part of the work listed in Paragraph 18 and other work that the Company deems necessary in connection with the trip.

  ② As a general rule, the hours during which tour conductors and other persons are engaged in the work mentioned in ① above are from 8:00 to 20:00.

  ③ The Labor Standards Act requires that employees take a certain amount of break time during work, so we ask for your understanding and cooperation.

(3) Local tour guide accompanying plan

In the local tour accompanying course, in principle, a local tour guide will accompany you from the time you arrive at your destination until your departure. The scope of duties of the local tour conductor shall be in accordance with the duties of the tour conductor in (1) of this section.

(4) Local staff guidance plan

A tour conductor will not accompany you on the local staff guidance course, but the local staff will perform the necessary tasks to make your trip smooth.

(5) Individual travel plan
